Terms and conditions for online purchases

1) Definitions

In these terms and conditions, the following terms shall have the following meanings, unless otherwise stated:

     (i)   The website – i-comment360 website at www.i-comment360.com
     (ii)  Purchaser – individual or company who is making a purchase from the i-comment360 website
     (iii) Item or items – online questionnaires and the resulting reports
     (iv) Participant – individual who will be completing an online questionnaire in order to produce a report.
     (v)  Point of sale - the time at which the Purchaser confirms their intention to purchase the item.

i-comment360 is the trading name of Organisational Reflections Ltd.  

i-comment360 aims to provide 360 feedback, Company and Team Surveys, Personality Profiles and other tools, delivered via online questionnaires and resulting reports.  360 feedback and Company Survey reports contain the information provided by the participants responding to the questionnaires and no other inputs.  The resulting data is analysed and presented in the reports.  The reports do not draw conclusions from the data, unless this is specifically requested. 

Personality Profiles are based on Jungian psychology and have been put together by a team with over 20 years’ experience in Personality Profiles.  The profiles are intended to provide advice and suggestions only.  They are not intended to be used as a substitute for counselling or other professional help.  I-comment360 accepts no responsibility for any actions taken as a result of reading these profiles. 

The following terms and conditions relate to the purchase of online questionnaires and reports via the website www.i-comment360.com and must be accepted to enable access the questionnaires and reports. 

These terms and conditions for online purchases should be read in conjunction with the terms and conditions related to the use of the website, the copyright statement and the privacy policy and data protection statements.

i-comment360 reserves the right to change these terms and conditions from time to time without prior notification. 

2) General conditions

All items purchased are for the sole use of the Purchaser (individual or organisation) and the Participant.  They are for private business and domestic use only. The Purchaser and the Participant undertake not to resell, copy or broadcast any items purchased from i-comment360 for their own commercial purposes.

All details provided through the site for the purposes of purchasing items are correct at the time of purchase.

All communication with i-comment360 in respect of the purchase of items should be done through the site or by email to admin@i-comment360.com

These terms and conditions shall be governed in all respects by Scottish law as if the contract was wholly entered into and wholly performed within Scotland. The parties hereby submit to the exclusive jurisdiction of the Scottish courts.

3)  Conditions of order processing

Items may be purchased using the following credit / debit cards: Delta, MasterCard, Maestro, Switch, Visa and American Express.  Payments are taken via the Stripe payment gateway. 

Once an order has been made via the website, each participant will be sent an e-mail link to the relevant questionnaire.  i-comment360 endeavours to send links out within 24 hours of order (although it is likely to be sooner).  Occasionally, technical reasons may result in a delay to participants receiving the link or being able to access the questionnaire. i-comment360 will make all reasonable endeavours to resolve any technical issues as soon as possible.

Reports are produced once the relevant questionnaires have been completed or on the close date for feedback to be submitted.  i-comment360 endeavours to send out reports within 24 hours of the questionnaire being completed for Personality Profiles or within 2 working days of the close date for feedback for 360 feedback or Surveys.  Occasionally, technical reasons may result in a delay to the delivery of reports however we will make all reasonable endeavours to resolve any technical issues as soon as possible.

Credit / debit cards are debited at point of sale as defined in clause 1) above. Any delay to the Purchaser's access to the item for technical reasons will be dealt with as outlined above.

Prices quoted on the site are inclusive of VAT and represent the price that will be charged to the Purchaser’s credit or debit card at point of sale.

The contract is formed between i-comment360 and the Purchaser at the point of sale and will be confirmed by email to the address supplied through the site. This confirmation email amounts to our acceptance of your offer to purchase the item.

Whilst i-comment360 makes every effort to ensure the accuracy of prices on the site, errors may occur. i-comment360 will use their best endeavours to correct any errors as soon as possible and to notify Purchasers of any amendments where such amendment affects their purchase of an item. The Purchaser will be given the option to cancel their order or to reconfirm the purchase of the item at the amended price. i-comment360 is under no obligation to fulfil a purchase order for an item which was advertised at the incorrect price.

Purchased items are non-exchangeable, non-transferable and non-refundable except where the Purchaser can prove that the item was wrongly described or was incorrectly supplied. 

Any issues with a questionnaire or report should be notified to i-comment360 by email to admin@i-comment360.com as soon as possible but no later than 14 days after point of sale. i-comment360 will take reasonable steps to resolve the issue within 14 days of notification or refund the cost of the item. 

It is the responsibility of the Purchaser to submit refund claims within 14 days of point of sale. Refunds will be at the discretion of i-comment360 and will be re-credited to the debit / credit card originally used for the purchase of the item. Such refunds will be processed within 14 days of receipt of the claim. i-comment360 reserves the right to refuse a refund and their decision is final.

Purchasers are able to cancel the purchase of an item prior to starting the questionnaire, in which event a refund will be issued.

Once the questionnaire has been started, cancellations will not be accepted unless covered by the clause above.

i-comment360 accepts no liability beyond a refund of the cost of the item.

4) Payment and pricing

i-comment360 reserve the right not to accept or process your order for any reason. All orders are subject to validation checks and authorisation by your payment card issuer. If we do not accept your order and your credit/debit card has already been debited, we will notify you and refund your card in full as soon as possible.

i-comment360 use the personal and transactional information (e.g. name, address, e-mail address, credit card details) Purchasers supply only in order to fulfil their order, unless they state otherwise. i-comment360 will retain Purchasers personal contact details within its database for the purposes of marketing and other notifications related to their order. Purchasers’ credit card details are not retained by i-comment360 but are passed to the external payment processor, Stripe.

 5)  Intellectual property, copyright notices and logos

For the purposes of these terms and conditions, Intellectual Property means the questionnaires, report and online systems, including the algorithms used to produce the reports from the answers to the questionnaires. 

Intellectual Property appearing on this website, in the questionnaires and reports is the copyright of i-comment360, the trading name of Organisational Reflections Ltd, and owner of the i-comment360 brand.  These materials must not be used, distributed, sold, adapted or reproduced in any medium without license.
